1. Acceptance of Terms
By accessing and using Black Sesame by SlimSnacks ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Description of Service
Black Sesame is a meal delivery service operated by SlimSnacks that provides weekly meal plans delivered to customers in Davao City, Philippines. We offer various meal plan types including High Protein, Power Lunch, Low Calorie, PCOS Friendly, and Plant Based options.
3. Account Registration
To use our service, you must:
- Be at least 18 years old
- Provide accurate, current, and complete information during registration
- Maintain and update your account information to keep it accurate
- Maintain the security of your account credentials
- Accept responsibility for all activities that occur under your account
4. Orders and Subscriptions
4.1 Order Placement
When you place an order, you are making an offer to purchase meals from us. We reserve the right to accept or reject your order for any reason, including but not limited to product availability, errors in pricing, or delivery area limitations.
4.2 Subscription Plans
Subscriptions are billed on a weekly basis. By subscribing, you authorize us to charge your payment method automatically each week until you cancel your subscription.
4.3 Cancellation
You may cancel your subscription at any time through your account dashboard or by contacting customer support. Cancellations must be made at least 48 hours before your next scheduled delivery to avoid being charged for that week.
5. Pricing and Payment
- All prices are in Philippine Pesos (PHP) and are subject to change without notice
- We reserve the right to correct pricing errors even after an order has been placed
- Payment must be made in advance for each delivery week
- We accept various payment methods including cash on delivery (COD), bank transfer, and online payment gateways
- Payment proof must be submitted within 24 hours of order placement for non-COD orders
6. Delivery
- We deliver to addresses within Davao City, Philippines
- Delivery days are typically Monday through Friday
- You must provide a complete and accurate delivery address
- Someone must be available to receive the delivery at the specified address
- We are not responsible for delays caused by factors beyond our control (weather, traffic, etc.)
- Delivery fees may apply based on location
7. Refunds and Returns
Due to the perishable nature of our products, we generally do not accept returns. However, we will provide refunds or replacements in the following circumstances:
- If meals are delivered in damaged or spoiled condition
- If there is an error in your order (wrong items, missing items)
- If delivery is not completed within the promised timeframe (subject to verification)
Refund requests must be made within 24 hours of delivery. Please contact customer support with photos and details of the issue.
8. Dietary Restrictions and Allergies
While we accommodate dietary preferences and restrictions, customers with severe allergies must inform us during registration. We cannot guarantee that our kitchen is completely free of allergens. Customers with life-threatening allergies should consult with us before subscribing.
9. Intellectual Property
All content on our website and in our communications, including text, graphics, logos, images, and software, is the property of Black Sesame by SlimSnacks or its content suppliers and is protected by Philippine and international copyright laws.
10. Limitation of Liability
To the maximum extent permitted by law, Black Sesame by SlimSnacks shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our service.
11. Indemnification
You agree to indemnify and hold harmless Black Sesame by SlimSnacks, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of the service or violation of these terms.
12. Modifications to Service
We reserve the right to modify, suspend, or discontinue any part of our service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the service.
13. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Davao City, Philippines.
14. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of any material changes via email or through our website. Your continued use of the service after such modifications constitutes acceptance of the updated terms.
